Focus Financial Files Trademark Suit Against Breakaway Advisors Over "Mosaic" Name

AdvisorHub reports that Focus Financial has initiated a trademark infringement lawsuit against three advisors who recently departed the firm's network and joined Mariner Wealth. The dispute centers on the advisors' use of the name "Mosaic Value Partners," which Focus alleges closely resembles an existing affiliated practice, Mosaic Family Wealth Partners.

Focus asserts that it has invested significant time and resources into developing the Mosaic brand and cultivating goodwill in the marketplace. The firm claims that the newly launched Mosaic Value Partners name creates a likelihood of consumer confusion because it targets the same client base and operates within the same channels. Focus filed the lawsuit shortly after the team's transition and seeks injunctive relief to prevent further use of the name, along with compensatory and punitive damages.

A spokesperson for Mariner did not respond to requests for comment. AdvisorHub notes that Mariner manages approximately $609 billion in assets, while Focus oversees about $500 billion in client assets. The litigation underscores the growing tensions that can arise when advisors transition between firms and seek to maintain continuity in branding and client relationships, according to AdvisorHub.
